By submitting and/or signing this "My Love Profile Form" I hereby acknowledge that I have read and agree to the Terms of Service, Privacy Policy and Confidentiality Agreement (set forth below) of LOVE AND MATCHMAKING, LLC ("Company"). I fully understand terms, conditions, all limitations of liability and indemnity obligations contained in any and all of the aforementioned agreements of Company. The information I have provided on this form is true and correct. I understand that additional agreements may be required for use of any Services offered by Company.  I acknowledge that I have advised to seek the advice of my own independently selected and retained counsel, concerning the nature, extent and duration of their respective rights, obligations and claims. I warrant and represent that in executing this Agreement I have relied solely upon my own respective judgments, beliefs and knowledge, and the advice and recommendations of my own independently selected and retained counsel, concerning the nature, extent and duration of my respective rights, obligations and claims. I hereby warrant, represent and agree that I have each been represented by counsel of my choice in negotiating and executing this Agreement or have had the opportunity to be represented by counsel and have waived this opportunity.

I also understand, acknowledge and agree to ALL of the following: 

1. I am a US citizen or legal resident of the US - unless I'm clearly stating that I am not in this My Love Profile Form.

2. I am at least 18 years of age, single or legally separated (unless seeking Relationship Coaching) and have no undisclosed mental or physical health issues or ailments, substance abuse issues or an undisclosed criminal record.

3. The means through which Company may communicate with me whether in-person, telephonically or by other electronic means is subject to change at any time in Company's sole and absolute discretion.

4. I am not seeking and Company is not providing any medical, psychological or other advice which requires any medical or other professional license. Any information, advice, suggestions or exercises recommended by Company is for general information purposes only and where necessary as determined in my sole discretion should be reviewed by a licensed therapist or other psychological professional.

5. It is agreed and acknowledged that Company may routinely conduct background checks on potential clients or individuals to whom Company may introduce or potentially introduce (each an “Introduction”) to any Client or Introductions. In some cases, Company may not conduct a background check. If any sort of background check is performed via Company or a third party service, Company makes no promises or guarantees to the validity or currency of such check, nor does Company disclose its methods for performing such checks. Company also does not meet all clients in a specific manner whether in person, via phone or video chats or other electronic means. Company does not meet all Introductions in a specific manner whether in person, via phone or video chat or other electronic means. Notwithstanding the foregoing, Company is not obligated to but may in its sole and absolute discretion conduct a background check on Client or Introduction. Client and/or Introduction hereby expressly authorizes Company to do same.  I provide my consent for Company to perform a background check on me.

6. I hereby release the Company and its members, employees, officers, directors, co-branders and other partners, agents, consultant representatives, attorneys and their respective successors and assigns from any and all claims, demands, any and all losses, damages, rights, and actions of any kind, including personal injuries, death, and property damage, that is either directly or indirectly related to or arises from your use of the Services, including but not limited to, any interpersonal interactions with or conduct of any person and of any kind arising in connection with or as a result of the Services. If you are a California resident, you hereby expressly waive California Civil Code Section 1542, which states, "A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his favor at the time of executing the release, which, if known by him or her or would have materially affected his or her settlement with the releasing party.”

7. I agree to indemnify, defend and hold harmless Company and its, subsidiaries, affiliates, officers, members, directors, co-branders and other partners, employees, consultants, agents, attorneys and representatives from and against any and all third-party claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and court costs) that such parties may incur as a result of or arising from my use of the Services.

8. I understand there are inherent risks involved in online and offline interactions with others including dating I am solely responsible for such interactions with others.  I agree to take all necessary precautions when meeting such individuals and to exercise prudent judgment and discretion. I expressly and completely assume any and all risks associated with any and all Services provided by Company.

9. I do not work for, own, plan to own or consult for any type of dating, relationship, matchmaking or introduction service.

10. I am not looking for financial  assistance or romantic arrangements to acquire financial support.

11. I do not have any undisclosed (to Company) bankruptcies or are in active bankruptcy proceedings.

12. Please note, Company makes absolutely no guarantees or warranties for any and all Services it provides. We advise anyone signing a legal document to first get counsel by a legal professional before signing. There are no refunds for any reason. Online or offline services or website access may be revoked from any user, free or paid, at any time for any reason by Company without refund or notice.

Our Service works best when you follow Our Protocols and Philosophy including: 

• Limit Texting - if a potential match begins texting you, please let them know you prefer phone calls over messaging. Texts should be for confirmation of a date (for the next day) and 'safely arrived home' post date only. Otherwise, we prefer NO TEXTING - especially in the beginning. 

• No Social Media - do not accept or request potential matches or freshmen dates on any platform until you are seriously dating towards a commitment. 

• No Pictures - never send a potential match a photo of yourself or photo link of yourself. Let us handle how we choose to match you.

• First Date(s) - meet at a public location. Keep some cash on you for emergencies. Make sure your phone is charged. Date should be dinner followed by a potential activity after (ice cream, dancing, a drink, etc). Dates should be on a Thursday, Friday or Saturday night when possible. No coffee dates. No day-dates. We encourage a kiss at the end of the date if there is any chemistry at all. Do not get drunk, participate in recreational drugs or ghost your date. Please, no sex on the first date. Be kind. Ping pong your conversation. Have fun!

• The Conversation - do NOT EVER talk about the Company (Love And Matchmaking LLC) or its Consultants or Principals, the dating process or platform you are using, your experiences dating, your exes or anything negative on your calls or physical dates. By signing this document, you agree to not talk about or share how Love And Matchmaking, its contractors or its referrers found you, or you found them. Keep talk about work and family/kids to a minimum. Keep it light and fun! Remember, it's just a date!

• Feedback - By signing this agreement, you agree that you will email us feedback/reviews on any calls or dates  to introductions you have through Love And Matchmaking within 48 hours. This is required.

• Confirmation - You must confirm via email all emails received from us and the understanding of the instructions contained within 24 hours.

• The Process - we are all unique, we’re all human. For some, this process goes fast, for others it may go very slow. Some may have many dates; others may have none. Love is beautiful, enjoy the journey… but remember, it’s more about the destination.

Please note for All submissions:

• Company will use commercially reasonable efforts as determined by Company to keep the information provided on this form private and confidential pursuant to the Privacy Policy, with the exception for use in providing Services.

• Company makes no representations, warranties, guarantees or promises in regards to any of the services offered or provided. 

• All submissions, requests, and clients are subject to approval. 

• Terms and Conditions and Terms and Services and our Privacy Agreement are subject to change at any time without notice. 

• Although we're working behind the scenes regularly, our usual Business Hours are Monday - Friday, 9AM-5PM PST. These hours/days may change without notice.

• You may receive email confirmation of receipt of this form once it has been processed - usually within 72 business hours. 

Confidentiality Agreement:
I acknowledge and agree that the Company's confidential information is highly valued and that during and after my relationship with the Company, I will have access to, receive or learn of information that is private and confidential to the Company. I understand that this information must be kept in strict confidence to protect the Company's reputation and good will and that the Company would be irreparably harmed by any disclosures of its Confidential Information. I acknowledge and agree that the restrictions in this Agreement are reasonable and necessary to protect the Company's legitimate privacy and business interests. I shall not use, disclose, disseminate or confirm, directly or indirectly, to anyone any statements, information or materials, whether or not acquired by me in the course of or in connection with the services rendered by anyone associated with Company or this website (LoveAndMatchmaking.com) (including consultants, contractors, partners, other clients or daters), that may harm, disparage, demean or reflect negatively or poorly upon or cause injury to the reputation, character or career of the Company or any of the Company Parties. The foregoing shall include but shall not be limited to the publishing of negative reviews anywhere whether in print, electronically and/or audio/video recording via print publications, social media platforms micro-blogging service; user-generated or user-uploaded content website; online forum, discussion thread or comment section; personal website or blog; user modified website ("wiki"); or any other website, service, platform, program, application or other form or method of communication, whether now known or hereinafter devised. 

To be removed from the Free Lovebase™ database, submit an emailed request to info@LoveAndMatchmaking.com. Identification verification may be required. Most removal requests honored within 72 business hours.  Removal from the Lovebase does not terminate your agreement to the above terms.

I acknowledge and understand that my use of Company's Free or Paid services can be revoked and/or terminated at any time by Company for any reason, including violation of any item included in this document. In the event of a conflict between these Terms and Conditions, the Privacy Policy and the Terms of Service, the Privacy Policy and Terms of Service shall govern.
